Use of Our Site 
The ARTCRANK website is for sharing things about bikes, poster art, artists, our shows and other events. We also have a shop where you can buy some of our artists’ posters and other items. The site is not intended and shouldn’t be used for other purposes. You may not copy, modify, distribute, display, create derivative works from, transfer, or sell any content on this site.

ARTCRANK Promotions
We may run promotions and special offers from time to time on the ARTCRANK website. You may not use multiple accounts or email addresses, or false names to game the system or take advantage of these promotions or offers. We will not honor any promotional or special offer in such circumstances.

Copyrights and Trademarks
The content of the ARTCRANK website, including text, design, graphics, interfaces, and code, and the posters and other artwork on the site, is is the property of ARTCRANK or our artists and other partners. All trademarks appearing on this site, including the ARTCRANK® name and logo, are the property of ARTCRANK.

Infringement
If you believe that your work has been copied to the ARTCRANK website in a way that constitutes copyright infringement, please notify us and include the following information:

  1. a description of the work that you claim has been infringed;
  2. a description of where that work is located on our site;
  3. your name, address, phone number, and email address where we can contact you
  4. a statement by you that you “have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law”;
  5. a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Applicable Law
Your use of the ARTCRANK website shall be governed by Minnesota and applicable U.S. laws, and you agree that jurisdiction over and venue in any legal proceeding arising out of or relating to this site or ARTCRANK products shall be in the state or federal courts located in Minneapolis, MN.

Arbitration
ARTCRANK may require you to submit any disputes arising from the use of this site or these Terms to final and binding arbitration under the International Rules of Arbitration of the American Arbitration Association. Any award in an arbitration shall be limited to monetary damages and shall include no injunction or direction to any party other than the direction to pay a monetary amount.

General
ARTCRANK may revise these Terms at any time by updating this posting. You should visit this page from time to time to review the then-current Terms because they are binding on you. Certain provisions of these Terms may be superseded by expressly designated legal notices or terms located on particular pages at this site.

TERMS OF SALE

These Terms of Sale apply to all of the posters and other items available for purchase on the ARTCRANK website.

A Few Words About Handmade Work
The original art posters we sell on our site are all produced using craft printing techniques, primarily screen-printing. This means each and every print is created by applying multiple layers of ink to paper, by hand — one color at a time, one poster at a time. The images you see on our site are accurate representations of each poster, and we won’t sell poorly printed posters with obvious flaws or mistakes. Please be aware that the print you receive may have variations that are common to handmade work. They give each print an individual, unique character that can’t be duplicated or matched by digital printing. They’re the hallmark of genuine works of art, and part of what gives each poster its value. We're happy to replace or issue refunds for posters that are damaged in shipping, or posters that you receive in error. Otherwise, all sales are final.

Pricing
The prices of our products change from time to time, and we cannot confirm the price of an item until you place an order. A small number of our items may be mispriced as a result of price changes that are implemented, however, we do NOT charge your credit card until after your order has entered the shipping process. If an item's correct price is higher than our stated price, your sole recourse is cancellation of your order. In the event a poster or other product is listed at an incorrect price due to typographical error or error in pricing information we received from a supplier, ARTCRANK may refuse or cancel any orders placed for product or service listed at the incorrect price. If your credit card has already been charged for the purchase and your order is canceled, ARTCRANK will issue a credit to your credit card account in the amount of the incorrect price.

Acceptance of Order
We reserve the right to refuse or cancel any order. In such event your sole recourse shall be the return of amounts paid by you related to such order (if any).

Sales Tax
Items shipped to destinations in the states of California and Minnesota are subject to tax. No sales tax is charged when purchasing gift certificates; however, purchases paid for with gift certificates may be subject to tax.

Return Rights and Instructions — Original Art Posters
We love our posters and the other items we sell, and we want you to love them too. We're happy to replace or issue refunds for posters that are damaged in shipping, or posters that you receive in error. Otherwise, all sales are final. (See return instructions below.)

Damaged Goods
If the package you receive is clearly damaged, please do not accept delivery of it. The package will be returned to us, and we will replace your poster or other item (if possible) or issue a full refund.

If you find that your poster or other item is damaged after opening the package, send an email to help@artcrank.com within 6 business days of receiving the package. If possible, please include a photo that shows the damage to your item. After recording the damage and emailing us, return the damaged or incorrect item to ARTCRANK. We will replace your item (if possible) or issue a full refund, including shipping and return costs.

Not the Item You Ordered
If you find that the poster or other item you received is not the one you ordered, send an email to help@artcrank.com within 6 business days of receiving the package. We will provide instructions for returning your poster in exchange for the correct one, or issuing you a refund.

Please note that all of the posters sold on our site are limited-edition prints, i.e., there are a limited number of copies in existence. We’ll make every effort to replace a damaged poster or a poster that is not what you ordered, but that may not always be possible. If we can’t get you the poster you wanted for any reason, we’ll issue a full refund, including shipping and return costs.

We will accept returns and exchanges only on unworn and unwashed merchandise. Please check the sizing charts found on apparel item pages before selecting a size and completing your purchase.

Return Rights and Instructions — Apparel & Other Merchandise
If you wish to return or exchange an unworn, unwashed apparel item, send an email to help@artcrank.com within 6 business days of receiving it. We will provide instructions for returning the item in exchange for a different size, or issuing you a refund.

Damaged Goods: If the package you receive is clearly damaged, please do not accept delivery of it. The package will be returned to us, and we will replace the item(s) you ordered (if possible) or issue a full refund.

If you find that your merchandise is damaged after opening the package, send an email to help@artcrank.com within 6 business days of receiving the package. If possible, please include a photo that shows the damage to your item. After recording the damage and emailing us, return the damaged or incorrect item to ARTCRANK. We will replace your item (if possible) or issue a full refund, including shipping and return costs.

Not the Item You Ordered: If you find that the poster or other item you received is not the one you ordered, send an email to help@artcrank.com within 6 business days of receiving the package. We will provide instructions for returning your poster in exchange for the correct one, or issuing you a refund.

We’ll make every effort to exchange an apparel item for a different size or replace damaged merchandise, but that may not always be possible. If we can’t get you the item you want in the size you want for any reason, we’ll issue a full refund, including shipping and return costs.

Product Descriptions
We attempt to describe our products offered as accurately as possible. However, we do not warrant that product descriptions, colors, sizes or other product information is 100% accurate, complete, reliable, current or error-free. If a product offered by us and purchased by you is not as described, your sole remedy is to return it in unused condition for a replacement, refund or credit. Please note that all returns must be made within 30 days of receipt.

Disclaimer
We are not liable for any financial damage (including but not limited to the cost of any replacement purchase) that may occur because of non-timely arrival or any lack of availability or conformity of the product.

Other Applicable Terms
The general terms above apply to all sales on the ARTCRANK website.

Modification And Severability
We reserve the right to make changes to these Terms of Sale at any time. You should review our policies, terms and conditions each time you visit the website and make a purchase.
